Agreement

These Terms govern access to and use of SmashOne, operated by SmashOne for the European public surface. Company registration details will be updated after KRS completion.

Service

SmashOne helps small businesses create, schedule, publish, and respond to social media activity across supported connected accounts. The base channels are Facebook, Instagram, and Telegram; WhatsApp Business, TikTok, and Google Business Profile are available as optional add-ons when enabled for your account. Third-party platforms remain independent services.

Add-on channels

WhatsApp Business, TikTok, and Google Business Profile are optional paid add-on channels, not part of the €99/month base subscription. Add-on channel fees are charged only if you choose the add-on and it is enabled for your account; the first add-on recurring charge, and any add-on setup fee, is charged on Day 15 after the 14-day free trial unless the checkout says otherwise. If an add-on channel is unavailable, withdrawn, or removed because of platform access, legal, safety, or policy requirements, SmashOne will not describe it as included, will avoid misleading availability claims under the EU Unfair Commercial Practices Directive (UCPD), and will stop future add-on charges for that removed channel.

Account responsibility

You are responsible for accurate account information, platform admin access, brand assets, product information, and maintaining permission to connect each social account.

Pricing

The base subscription is €99/month EUR and includes Facebook, Instagram, Telegram, and AI assistant usage with 1,000 answers/month. Add-ons are WhatsApp €29/month, TikTok €19/month, and Google Business Profile €39/month. Each add-on also carries a one-time setup fee charged only when an Automator performs the setup (WhatsApp €49, TikTok €39, Google Business Profile €149); self-service setup is €0. Add-ons are charged independently.

Billing cycle

Subscriptions are billed monthly. Your billing date is the day your paid subscription begins: Day 15 immediately after the 14-day free trial ends.

Trial and refunds

Days 1–14 are free. If you are charged on Day 15 and decide SmashOne is not for you, you may request a full refund of the base subscription within 14 days of first billing, Days 15–29. Refunds are processed to the original payment method within 5–10 business days.

Automator setup paths

Paths 1, 3, and 4 are automator-led. A vetted contractor manually connects platforms, configures the AI assistant, imports up to 50 catalog items, and schedules the first week of posts. The one-time setup fee is €199 and is charged on Day 15 when setup work has been performed.

Setup fee refund rule

Setup fees are refundable before setup work is performed and become non-refundable once manual platform connection work has been performed. The base subscription remains refundable during the subscription money-back window even when setup fees are not.

Acceptable use

Customers may not use SmashOne for unlawful content, spam, platform manipulation, deceptive impersonation, harassment, malware, prohibited goods, or content that violates connected platform policies.

AI assistant

The AI assistant generates automated replies from your catalog, FAQ, and configured tone. You retain editorial control and may switch conversations to manual mode at any time. AI messages are clearly disclosed as powered by SmashOne AI.

Privacy rights

EU users can request access, deletion, correction, restriction, portability, or objection under GDPR. Poland data-protection authority reference: UODO. SmashOne does not sell personal information. Requests go to info@smashone.ai.

Notice and action

To report content you believe is illegal under EU or member-state law, send an email to info@smashone.ai with the URL, a description of the content, your contact details, and a statement of your good-faith belief that the content is illegal. We will acknowledge receipt within 72 hours, decide on the report within 14 days, and inform you of the outcome with reasons. You may appeal an unfavourable decision by replying to the same email within 30 days. We retain notices for internal record. This procedure follows the EU Digital Services Act Article 16.

AI assistant transparency

AI Act · Article 50

Conversations with SmashOne are clearly labelled as automated. The AI assistant drafts responses from your business catalog, FAQ, and configured tone. Automated decisions that affect you materially — refund eligibility, account suspensions, ToS violations — are reviewable by a human within 14 days on written request to info@smashone.ai. This follows the EU AI Act Article 50 transparency obligations applicable from 2 August 2026.

Governing law and jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims), are governed by the law of Poland, without regard to its conflict-of-law rules. If you are a consumer, this choice of law does not deprive you of the protection afforded to you by provisions that cannot be derogated from by agreement under the law of the country where you have your habitual residence (Article 6(2) of Regulation (EC) No 593/2008, "Rome I"). Nothing in these Terms limits your mandatory statutory consumer rights. Jurisdiction: if you are a consumer, you may bring proceedings in the courts of Poland or in the courts of the EU Member State where you are domiciled, and proceedings against you may only be brought in the courts of the Member State where you are domiciled (Articles 17–19 of Regulation (EU) No 1215/2012, "Brussels I bis"). If you are a business, the courts of Warszawa, Poland have exclusive jurisdiction. Resolving disputes: we will always try to resolve any issue with you directly first — please write to info@smashone.ai before taking any other step. If you are a consumer resident in the EU, this does not affect your right to bring a dispute before the competent courts or to use any out-of-court dispute-resolution mechanism available to you under the law of your country of residence.

Limitation of liability

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, and for any liability that cannot be excluded or limited under applicable mandatory law. If you are a consumer, nothing in these Terms affects your mandatory statutory rights, including your rights in respect of services that are not provided with reasonable care and skill, your right of withdrawal, and your right to a refund as described in these Terms. We are responsible for foreseeable loss and damage caused by us; we are not responsible for any loss or damage that was not foreseeable at the time you started using the service. If you are a business, we are not liable for loss of profits, loss of business, business interruption, loss of anticipated savings, or any indirect or consequential loss. Subject to the first paragraph above, our total aggregate liability to a business arising out of or in connection with these Terms is limited to the total fees you paid to us in the twelve (12) months immediately before the event giving rise to the claim. The service is a tool that assists you in running your social presence; you remain responsible for the content published from your account and for your communications with your customers, including any messages drafted with the help of the AI assistant.
